电商“夸张式宣传”下消费者权益的保护
Protection of Consumers’ Rights and Interests under E-Commerce “Exaggerated Propaganda”
摘要: 随着互联网技术的飞速发展,网络购物已成为消费者重要的购物方式。然而,网络购物给消费者带来方便的同时,各种侵害消费者权益的套路频出,消费者权益的保护问题日益凸显。含糊其词的“夸张式宣传”由于其取证难、认定难,维权成本高,成为部分不良商家常用的销售手段。由于网络购物的特殊性及我国司法中的一些不足,消费者权益并未得到及时的救济。加强网络购物消费者的保护,应加大理性消费宣传、培养消费者网络购物留痕及理性消费的习惯、加大行政处罚的力度。
Abstract: With the rapid development of Internet technology, online shopping has become an important way of shopping for consumers. However, while online shopping brings convenience to consumers, a variety of routines that infringe on consumers’ rights and interests frequently appear, and the protection of consumers’ rights and interests has become increasingly prominent. Vague “exaggerated propaganda” has become a common means of sales for some bad businesses because of its difficulty in obtaining evidence, identification and high cost of safeguarding rights. Due to the particularity of online shopping and some deficiencies in China’s judiciary, the rights and interests of consumers have not been timely relieved. To strengthen the protection of online shopping consumers, we should strengthen rational consumption propaganda, cultivate consumers’ habit of online shopping and rational consumption, and increase the intensity of administrative punishment.
