Analysis of the Current Situation of Judicial Review and Disciplinary Actions against Students in Universities

摘要: 本文分析了高校处分学生行为与司法审查的现状和问题，并提出了完善路径。文章指出随着我国高等教育转型的进行，学生对高校内部管理行为进行司法审查的案件逐渐增多，且存在一些问题。其中，高校处分学生行为的法律依据不足、行使过程失范和学生权利救济的问题是主要的。文章建议明确司法审查的法律依据，规范审查的范围和限度，建立有效的救济途径，同时加强高校的内部管理和自我监督机制。通过这些完善措施，来保护学生的合法权益，维护高校自主权和司法审查的平衡。

Abstract: This article analyzes the current situation and problems of disciplinary actions against students in universities and judicial review, and proposes improvement paths. The article points out that with the transformation of higher education in China, the number of cases where students subject internal university management actions to judicial review is gradually increasing, and certain issues exist. These issues mainly include insufficient legal basis for disciplinary actions against students in universities, improper exercise of authority during the process, and lack of student rights relief. The article suggests clarifying the legal basis for judicial review, specifying the scope and limits of review, establishing effective channels for student recourse, and strengthening internal university management and self-supervision mechanisms. Through these improvement measures, the aim is to protect students’ legitimate rights and interests, and maintain a balance between university autonomy and judicial review.
