法律视角下丹寨县土地流转现状及问题研究

Study on the Current Situation and Problems of Land Transfer in Danzhai County under the Legal Perspective

摘要: 随着中国农村经济的快速发展，土地流转成为推动农业现代化和农村经济发展的重要途径。但土地的流转涉及到多方群体的利益，是较为复杂的社会问题。丹寨县作为典型的农业县，其农村土地流转的现状和问题具有代表性。因此从法律视角出发，分析丹寨县农村土地流转的现状，并探讨丹寨县土地流转过程中所存在的诸如对土地流转合同的规范化程度不高、对土地权益保护不足以及缺乏土地流转的监管与纠纷解决机制等问题，并提出完善法律法规，确保流转合法性、建立和完善土地流转市场以及充分保障农民的土地承包经营权和收益权等对策。

Abstract: With the rapid development of China’s rural economy, land transfer has become an important way to promote agricultural modernization and rural economic development. However, land transfer involves the interests of multiple groups and is a relatively complex social issue. As a typical agricultural county, Danzhai County is representative of the current situation and problems of rural land transfer. Therefore, from the legal perspective, we analyze the current situation of rural land transfer in Danzhai County, and discuss the problems existing in the process of land transfer in Danzhai County, such as the low degree of standardization of the land transfer contract, insufficient protection of the rights and interests of the land and the lack of supervision of the land transfer and dispute resolution mechanisms, and put forward countermeasures to improve laws and regulations to ensure the legality of the transfer, establish and improve the land transfer market, and fully protect the farmers’ right to operate and benefit from the land contract.
