AI绘画著作权法定许可制度适用问题研究

Research on the Application of the Legal Licensing System for AI Painting Copyright

摘要: 在数字化时代，人工智能技术的不断突破，新技术的出现对传统著作权法体系提出了新的挑战，而AI绘画作为一种新型的艺术创作形式受到社会各界广泛关注。随着AI绘画快速发展及广泛的应用，现行法律体系已无法满足其发展需求，难以全面规制其中的法律风险。本文首先对AI绘画所引发的法律风险进行讨论，其次对人工智能生成物的可版权性进行分析，然后从法理基础和技术依据两方面阐述AI绘画适用法定许可制度的合理性，最后提出规范进路。我们有必要在现有立法的基础上，考虑将法定许可制度灵活应用于AI绘画创作活动中，以适应技术发展的同时确保著作权的合理保护。

Abstract: In the digital era, the continuous breakthrough of artificial intelligence technology and the emergence of new technologies pose new challenges to the traditional copyright law system, while AI painting, as a new form of artistic creation, has attracted wide attention from all walks of life. With the rapid development and wide application of AI painting, the current legal system has been unable to meet its development needs, and it is difficult to fully regulate the legal risks. Firstly, this paper discusses the legal risk caused by AI painting, secondly analyzes the copyright of artificial intelligence products, then expounds the rationality of AI painting applying legal license system from two aspects of legal basis and technical basis, and finally puts forward a standardized approach. It is necessary for us to consider the flexible application of statutory licensing system to AI painting creation activities on the basis of existing legislation, so as to adapt to the development of technology and ensure the reasonable protection of copyright.
