Research on the Legal Protection of Intellectual Property Rights in Clothing Design

摘要: 随着科技和文化的发展，人们对服饰的要求不断提高。然而，在近几年的司法实践中，这些具有独创性、艺术性的作品往往会被侵犯，无法得到有效的保护。如何防止别人的剽窃、仿冒，这是一个令人头痛的问题。许多国家都把服装设计列入了知识产权法律保护范畴，而我国却没有明确规定服装设计的法律保护。因此，如何加强对服装设计知识产权的保护，是当前我国服装产业发展的当务之急。本文立足于我国的实际情况，根据我国著作权法和专利法的优缺点，提出了完善我国服装设计的相关构想，使之得到更全面的保护，促进我国服装行业的发展。

Abstract: With the development of science and technology and culture, people’s requirements for clothing continue to increase. However, in the judicial practice in recent years, these original and artistic works are often violated and cannot be effectively protected. How to prevent other people’s plagiarism and counterfeiting is a headache. Many countries have included clothing design in the scope of the legal protection of intellectual property rights, but China does not clearly stipulate the legal protection of clothing design. Therefore, how to strengthen the protection of intellectual property rights in clothing design is a top priority for the development of China’s clothing industry. Based on the actual situation in China, this article puts forward the relevant ideas of improving China’s clothing design according to the advantages and disadvantages of China’s copyright law and patent law, so that it can be more comprehensively protected and promote the development of China’s clothing industry.
