马克思主义自由观视阈下网络言论自由的法律规制研究

Study on the Legal Regulation of Internet Freedom of Expression under the Threshold of Marxist View of Freedom

摘要: 马克思主义自由观认为“自由”是人类生存中自觉的、能动的一种状态，制约于生产力和生产关系的发展水平，具有社会性和历史性。科学技术的飞速发展为网上言论的自由表达提供了条件，与此同时也出现了滥用自由而发生的网络失范行为，因此对网络言论自由进行法律规制具有必要性。针对规制网络言论自由的立法、行政执法、公正司法、网民守法方面存在的实践问题提出落实网络言论自由的相关法律法规、明确执法主体、健全执法程序、加强法治宣传教育，增强网民法律意识等建议以推动实现网络空间安全有序发展。

Abstract: The Marxist view of freedom is that “freedom” is a conscious and dynamic state of human existence, constrained by the level of development of the productive forces and relations of production, and of a social and historical nature. The rapid development of science and technology has provided the conditions for the free expression of online speech, but at the same time, there are also network misconduct behaviours occurring as a result of the abuse of freedom, so it is necessary to legally regulate the internet freedom of expression. In view of the practical problems that exist in the areas of legislation, administrative law enforcement, impartial justice, and netizens’ compliance with the law to regulate the internet freedom of expression, recommendations have been made to implement the relevant laws and regulations on the internet freedom of expression, to clarify the main body of law enforcement, to improve the law enforcement procedures, to strengthen the rule of law publicity and education, and to enhance the legal awareness of netizens in order to promote the safe and orderly development of the cyberspace.
