我国地理标志法律保护制度思考

Reflections on the Legal Protection System of Geographical Indications in China

摘要: 新时代乡村振兴战略实施背景下，丰富的地理标志资源逐步成为推动乡村特色产业经济兴旺发达的重要驱动力。作为知识产权保护对象的地理标志，具有显著的时代重要性特征，在我国现代市场上扮演了较为特殊的角色。实践中，对于地理标志的法律保护存在两种模式、三种制度并行局面，造成保护重叠、标准不一等问题，给地理标志保护的完善与发展带来一定的困难与制约。亟需构建系统性、专业性地理标志法律保护体系，以提升地理标志保护水平。

Abstract: In the context of the implementation of the strategy of rural revitalization in the new era, the rich geographical indication resources have gradually become an important driving force to promote the economic prosperity of rural characteristic industries. As the object of intellectual property protection, geographical indications have significant characteristics of the importance of the times, and play a special role in China’s modern market. In practice, there are two modes and three parallel systems for the legal protection of geographical indications, resulting in overlapping protection, different standards and other problems, which bring certain difficulties and constraints to the improvement and development of geographical indications protection. There is an urgent need to build a systematic and professional legal protection system for geographical indications in order to enhance the level of protection of geographical indications.
