网络暴力行为的法律规制研究

摘要: 互联网时代的飞速发展带来的不仅是信息的互通有无，与此同时，也带来了一些不可忽视的网络问题，近些年来网络暴力事件的频发成为大众关注的焦点。与传统暴力相比，网络暴力具有隐蔽性、时空性和不可控性，这些特点使得网络暴力行为面临着取证难、追责难、监管难的困境，无法完全保障公民的权利救济。为及时有效地打破这一困境，应当进一步优化网络平台的技术取证手段，构建以反对网络暴力行为为中心的法律法规体系，同时建立多方协同监管体制机制，以法律手段推动网络暴力治理，营造风清气正的网络环境。

Abstract: The rapid development of the Internet era brings not only the exchange of information, but also some network problems that cannot be ignored. In recent years, the frequent occurrence of cyber violence has become the focus of public attention. Compared with traditional violence, cyber violence has the characteristics of concealment, time and space and uncontrollability, which makes cyber violence face difficulties in obtaining evidence, tracing blame and supervision, and cannot fully protect citizens’ rights relief. In order to break this dilemma in a timely and effective manner, it is necessary to further optimize the technical forensic means of the network platform, build a legal and regulatory system centered on opposing cyber violence, and establish a multi-party collaborative regulatory system and mechanism to promote the governance of cyber violence with the legal system, and create a clean and positive network environment.
