法教义学在中国的起源与发展综述
A Review of the Origin and Development of Legal Dogmatics in China
摘要: “法教义学”是具有德国色彩的法学用语，坚持对于法律事业的内在态度，是一种典型的“法学内的法学”。法教义学在近十年才被中国法学界所知并开展热烈的讨论。法教义学与社科法学之争反映了当代中国法学的方法论觉醒。本文聚焦于法教义学在中国的发展，以及中国学者对于法教义学的观点，结合法教义学在我国现有的理论研究现状，助力于构建中国法学知识体系，以推动法教义学中国本土化研究。
Abstract:
“Legal Dogmatics” is a legal term with German characteristics, adhering to an inherent attitude towards the legal profession, and is a typical “law within the field of law”. The study of Legal Dogmatics has only been known to the Chinese legal community in the past decade and has been actively discussed. The debate between Legal Dogmatics and social science law reflects the methodological awakening of contemporary Chinese law. This article focuses on the development of Legal Dogmatics in China, as well as the views of Chinese scholars on Legal Dogmatics. Combining with the current theoretical research status of Legal Dogmatics in China, it helps to construct a knowledge system of Chinese law and promote the localization research of Legal Dogmatics in China.
