数字遗产继承的法律问题研究

摘要: 随着信息化时代的飞速发展，数字财产的价值属性日渐凸显，随之带来的关于数字遗产的继承问题也成为了社会中较为常见的法律问题。本文从数字遗产的法律属性进行探讨、指出数字遗产继承法律不完善、数字遗产继承主体不明确、数字遗产继承权与逝者隐私利益冲突以及网络服务协议阻碍数字遗产的继承等障碍。最后从数字遗产继承主体认定、数字遗产的继承范围的明确、网络服务协议改进等方面提出建议，以期为数字遗产的继承提供合理的框架。

Abstract: With the rapid development of the information age, the value attribute of digital property has become increasingly prominent, and the inheritance of digital heritage has become a common legal problem in the society. This paper discusses the legal attribute of digital heritage, and points out the obstacles such as the imperfect law of digital inheritance, the unclear subject of digital inheritance, the conflict of digital inheritance and the privacy interest of the deceased, and the network service agreement hindering the inheritance of digital inheritance. Finally, suggestions are put forward from the identification of digital inheritance subject, the clear scope of digital inheritance, and the improvement of network service agreement, in order to provide a reasonable framework for the inheritance of digital heritage.
