对政府采购活动中异常低价投标行为的探讨——从财政部政府采购指导性案例19号切入

A Discussion on Abnormally Low Bidding Behaviors in Government Procurement Activities—Starting from the Ministry of Finance’s Government Procurement Guiding Case No. 19

摘要: 本文以财政部政府采购第19号指导性案例为切入点，探讨政府采购中异常低价投标行为的危害性。我国《政府采购法》《招标投标法》《政府采购货物和服务招标投标管理办法》等法律文件虽对异常低价投标行为作了相应规定，但不足在于《政府采购货物和服务招标投标管理办法》第六十条中关于“明显低于”的标准模糊。为降低异常低价投标行为的发生概率，未来应完善“明显低于”的认定标准，加强招标文件编制的规范性，建立合理的监督制度。

Abstract: This article takes the Ministry of Finance’s Government Procurement Guiding Case No. 19 as a starting point to explore the harmfulness of abnormally low bidding in government procurement. Although China’s “Government Procurement Law”, “Tendering and Bidding Law”, “Measures for the Administration of Bidding and Bidding for Government Procurement of Goods and Services” and other legal documents have made corresponding provisions on the behavior of abnormally low prices, the shortcomings lie in the vagueness of the standard of “significantly lower” in Article 60 of the “Measures for the Administration of Bidding and Bidding for Government Procurement of Goods and Services”. In order to reduce the probability of abnormally low bidding behavior, the identification standard of “significantly lower” should be improved in the future, the standardization of the preparation of bidding documents should be strengthened, and a reasonable supervision system should be established.
