行政检察履职推动实现企业行政合规制度完善

摘要: 检察机关开展涉案企业合规工作全面铺开，针对涉嫌犯罪的企业实施“刑事合规改革”目前已经形成一套行之有效的制度经验，但其本质上仍然是一种事后整改机制，针对目前检察机关参与企业行政合规工作的机制缺失，应从明确检察机关在企业行政合规中的监督角色定位、监督重点，刑事合规与行政合规衔接贯通以及以深化社会治理等方面探索一套检察机关推动、参与企业行政合规的工作体系，形成符合社会治理、诉讼制度、法律监督运行要求，更科学的监管模式、高效的运行机制和明确的责任体系，为立法完善提供实践积累。企业合规不起诉制度的成熟完善也必然会推动形成一套以预防为主的前端管控程序。

Abstract: The procuratorial organs have carried out the compliance work of enterprises involved in the case in an all-round way, and implemented the “criminal compliance reform” for enterprises suspected of committing crimes. At present, a set of effective institutional experiences has been formed, but it is still an after-the-fact rectification mechanism. In view of the lack of the mechanism for procuratorial organs to participate in enterprise administrative compliance work, we should clarify the supervisory role and supervision focus of procuratorial organs in enterprise administrative compliance. Linking criminal compliance with administrative compliance and exploring a working system for procuratorial organs to promote and participate in enterprise administrative compliance by deepening social governance, so as to form a more scientific supervision mode, efficient operation mechanism and clear responsibility system that meets the operational requirements of social governance, litigation system and legal supervision, and provide practical accumulation for legislative perfection. The maturity and perfection of enterprise compliance non-prosecution system will inevitably promote the formation of a set of prevention-oriented front-end control procedures.
