游戏直播画面著作权归属问题研究
Research on Copyright Ownership of Live Video Game
摘要: 在网络游戏直播产业中,游戏直播画面著作权归属是相关主体最为关心的问题,权利归属的明晰有利于减少纠纷产生。目前学术界针对该问题未达成统一意见。针对游戏直播画面的著作权归属认定,笔者认为不能一概而论,而应结合不同游戏类别和不同直播类型进行判断。同时由于竞技类游戏和自由类游戏直播并不会影响游戏原有的市场环境,可构成合理使用,而剧情类游戏直播是一种提前“剧透”行为,可能对现有游戏市场产生影响,因此不应视为合理使用。
Abstract:
In the online game live broadcast industry, the copyright ownership of the game live broadcast screen is the most concerned issue of the relevant subjects, and the clarity of the right ownership is conducive to reducing disputes. At present, the academic circles have not reached a unified opinion on this issue. The author believes that the copyright ownership of live video game cannot be generalized, but should be combined with different game categories and different types of live video to judge. At the same time, since the live broadcast of competitive games and free games does not affect the original market environment of the game, it can constitute fair use, while the live broadcast of drama games is a kind of behavior of “revealing the story” in advance, which may have an impact on the existing game market, so it should not be regarded as fair use.
