我国校园体育活动中人身伤害案件法律条款运用的法理分析

Legal Analysis of the Application of Legal Provisions on Personal Injury Cases in Campus Sports Activities in China

摘要: 目前我国教育法治建设相对滞后，特别是在校园体育人身伤害及侵权问题上，缺乏相关法律法规，校园体育伤害事故在司法实践领域中的矛盾也日益突出。本研究从民事侵权的法律、法理层面深入分析我国校园学生体育人身伤害事故适用的法律条款依据、归责原则适用、体侵权责任认定以及“甘冒风险”原则的运用等重要问题。在法理分析的基础上，探讨了在我国校园体育人身伤害事故诉讼审判过程中法院引用法律条款存在的问题与不足，为妥善解决校园体育人身伤害事故提供法理依据和实践思路。

Abstract: At present, the construction of the rule of law in education in China is relatively lagging, especially in the field of personal injury and infringement on campus sports, there is a lack of relevant laws and regulations, and the contradiction of campus sports injury accidents in the field of judicial practice is also increasingly prominent. This study analyzes in depth the legal issues of civil tort law and jurisprudence from the basis of the applicable legal terms of the campus student sports personal injury accidents, the application of the liability principle, the determination of the tort liability, and the application of the “taking risks” principle. Based on the analysis of legal principles, the paper discusses the problems and deficiencies of the courts in citing legal provisions during the trial process of personal injury accidents on campus sports in China.
