我国志愿者保险制度的创新研究

摘要: 志愿者在开展志愿服务时遭遇诸多风险，保险制度作为志愿者权利救济和权益保障的重要内容，理应发挥基石作用，但目前志愿者保险制度存在诸多问题，其症结在于目前将其定性为商业保险，商业保险自身的天然内生性问题，很难从根源上修正，因而，无法将志愿服务的损害救济全部交给商业保险机制来承担，政策性保险工具在志愿者保险制度的应用中具有显著优势，运用政策性保险工具，并在此基础上构建中国特色志愿者保险制度，完善志愿者损害救济制度，维护志愿者的合法权益。

Abstract: As an important part of the relief and protection of the rights and interests of volunteers, the insurance system should play a cornerstone role. However, there are many problems in the current volunteer insurance system, the crux of which lies in the fact that it is currently characterized as commercial insurance, and the natural endogeneity of commercial insurance itself is difficult to correct from the root cause. It is impossible to entrust all the damage relief of volunteer service to the commercial insurance mechanism, and policy-based insurance tools have significant advantages in the application of the volunteer insurance system. On this basis, policy-based insurance tools are used to build a volunteer insurance system with Chinese characteristics, improve the volunteer damage relief system, and safeguard the legitimate rights and interests of volunteers.
