我国非物质文化遗产传承人权益的法律保护探究

摘要: 传承人作为非物质文化遗产活的载体，其权益保护是非物质文化遗产保护的关键。目前，法律对于传承人权益的保护存在认定制度和取消制度不完善、权利界定不清、保护力度不足等问题，亟需加强相关立法和制度建设。应积极借鉴他国成功经验，规范认定标准和程序，完善资金保障，并营造良好的法治环境和社会氛围，以切实维护传承人的合法权益。

Abstract: As the living carrier of intangible cultural heritage, the protection of the rights and interests of inheritors is the key to the protection of intangible cultural heritage. At present, there are some problems in the protection of the rights and interests of inheritors, such as the imperfect recognition system and cancellation system, the unclear definition of rights, and the insufficient protection of rights, and it is urgent to strengthen the construction of relevant legislation and systems. It is necessary to actively learn from the successful experience of other countries, standardize the identification standards and procedures, improve financial guarantees, and create a good legal environment and social atmosphere, so as to effectively protect the legitimate rights and interests of inheritors.
