New Characteristics, Hazards, and Regulation of Cyber Violence

摘要: 在“舆论爆棚”的背景下，网络暴力已成为一个不容忽视的社会问题，展现出随机性、玩乐性、间接性和游离性等新特点，这增加了网络暴力的不可预测性和治理难度。本文探讨了网络暴力对社会道德、公共秩序、理性对话和安全感的破坏，同时也论述了现有法律规制中的不足，如定义模糊、条文分散、监管不力等。为有效治理网络暴力，文章提出了优化路径，包括落实专项立法、细化追责制度、完善实名制、构建多元化监管机制、创新审判方式和畅通救济渠道等。旨在营造一个健康、有序的网络空间，保护网民权益，推动社会和谐发展。

Abstract: Against the backdrop of “public opinion explosion”, cyberbullying has become an inescapable social issue, exhibiting new characteristics such as randomness, playfulness, indirectness, and detachment, which increase the unpredictability and difficulty of managing cyberbullying. This article explores the damage of cyberbullying to social morality, public order, rational dialogue, and a sense of security, and also discusses the shortcomings in existing legal regulations, such as vague definitions, scattered provisions, and inadequate supervision. To effectively manage cyberbullying, the article proposes an optimization path, including implementing special legislation, refining the accountability system, improving the real-name system, building a diversified supervision mechanism, innovating trial methods, and smoothing relief channels. The aim is to create a healthy and orderly online space, protect the rights and interests of netizens, and promote harmonious social development.
