Regulatory Status and Path Optimization of Personal Information Protection in the Transaction Process of E-Commerce Platforms

摘要: 随着数字经济的飞速发展，大数据应用成为推动电子商务时代的关键力量，个人信息保护也面临严峻挑战。电子商务法对个人信息保护作了原则上的规制，使用上的限制，安全上的保障，但电商平台交易过程中仍然面临平台隐形的算法歧视、监管力度不足以及维权渠道不畅的缺陷。个人信息保护方面应通过消解歧视、构建多元监管体系、畅通维权渠道来保护用户权益、建立信任和促进电子商务的健康发展。

Abstract: With the rapid development of the digital economy, the application of big data has become a key force to promote the era of e-commerce, and the protection of personal information is also facing serious challenges. The e-commerce law has regulated the protection of personal information in principle, restricted its use, and guaranteed its safety, but e-commerce platforms still face the deficiencies of invisible algorithmic discrimination on the platforms, insufficient supervision, and poor channels for the protection of rights during the transaction process. The protection of personal information should protect users’ rights and interests, build trust and promote the healthy development of e-commerce by eliminating discrimination, constructing a diversified regulatory system, and opening up channels for rights defense.
