摘要: 在我国司法实践中，案例指导制度作为一种具有鲜明中国特色的创新机制，已经在多个领域得到了广泛地应用。特别是在刑事司法领域，案例指导制度的应用被视为该体系中的一个关键组成部分。然而，随着这一制度的不断深化，其在实际运作过程中也暴露出了一系列问题。刑事指导性案例在司法实践中的核心地位不容忽视，但它们在定位上的模糊不清、以及在覆盖面上的局限性，已经成为制约其功能发挥的重要因素。这些问题不仅影响了案例指导制度的有效性，也对司法公正和法律统一性构成了潜在威胁。本文认为有必要对刑事指导性案例在司法适用中所面临的困境，探索更为有效的解决方案。文章将结合法学理论界的观点和指导性案例在实际适用中的具体情况，对当前刑事指导性案例所面临的问题进行系统地分析，并在此基础上提出一系列切实可行的建议，以期为完善我国刑事司法领域的案例指导制度提供理论支持和实践指导。

Abstract: In China’s judicial practice, case guidance system, as an innovative mechanism with distinctive Chinese characteristics, has been widely used in many fields. Particularly in the field of criminal justice, the application of the case guidance system is seen as a key component of the system. However, with the deepening of this system, a series of problems have been exposed in the actual operation process. The core position of criminal guiding cases in judicial practice cannot be ignored, but their ambiguity in positioning and limitation in coverage have become important factors restricting their function. These problems not only affect the effectiveness of the case guidance system, but also pose a potential threat to judicial justice and legal unity. This paper believes that it is necessary to explore more effective solutions to the difficulties faced by the judicial application of criminal guidance cases. This paper will systematically analyze the problems faced by the current criminal guidance cases by combining the viewpoints of the legal theory circle and the specific situation of the guiding cases in practice, and on this basis, put forward a series of practical suggestions, in order to provide theoretical support and practical guidance for improving the case guidance system in the criminal justice field of our country.
