网络暴力的法律规制研究

摘要: 在信息时代，网络暴力如同一把双刃剑，一方面，它放大了言论的自由和信息的流通，另一方面，也加剧了信息的混乱和人际关系的紧张，尤其是对个人的尊严和权益构成了严重威胁。因此，对网络暴力进行有效的法律规制，既是维护网络环境健康，保护公民合法权益的需要，也是构建和谐社会，推动网络社会文明进步的重要举措。本文通过叙述网络暴力的定义和现状，分析当前我国对网络暴力的法律规制存在的不足之处，并通过明确法律责任、细化法律条文、落实责任追究、完善监管机制、加强技术手段应用以及提高公众法律意识和素养等措施，不断完善针对于网络暴力的法律规制，从而有效遏制网络暴力的发生。未来，随着技术的不断进步和法律法规的不断完善，相信网络暴力的法律规制将会取得更加显著的成效。

Abstract: In the information age, cyber violence is like a double-edged sword. On the one hand, it magnifies the freedom of speech and the flow of information; on the other hand, it also intensifies the confusion of information and the tension of interpersonal relations, and poses a serious threat to the dignity and rights of individuals. Therefore, effective legal regulation of network violence is not only the need to maintain the health of the network environment and protect the legitimate rights and interests of citizens, but also an important measure to build a harmonious society and promote the civilization and progress of the network society. By describing the definition and status quo of cyber violence, this paper analyzes the shortcomings of China’s current legal regulations on cyber violence, and constantly improves the legal regulations on cyber violence by clarifying legal responsibilities, refining legal provisions, carrying out accountability, improving regulatory mechanisms, strengthening the application of technical means, and improving the public’s legal awareness and literacy. So as to effectively curb the occurrence of cyber violence. In the future, with the continuous progress of technology and the continuous improvement of laws and regulations, it is believed that the legal regulation of cyber violence will achieve more significant results.
