网络直播中音乐作品的版权保护问题研究

Research on Copyright Protection of Music Works in Online Live Streaming

摘要: 在网络直播领域，主播们常借助他人音乐作品作为吸引观众的亮点，但在实际操作中，往往忽视了对这些作品合法授权的核查，从而引发了一系列涉及表演权、信息网络传播权及广播权等著作权的侵权行为。鉴于此，结合相关的司法案例对此类侵权行为和救济措施进行细化分析研究。在未来实践中，应完善并细化相关法律条文、培养公众的版权保护意识、解决著作权人请求赔偿损失困难问题以期规范直播行业对音乐作品的使用。

Abstract: In the field of online live streaming, anchors often use other people’s music works as highlights to attract audiences. However, in practical operation, they often neglect the verification of the legal authorization of these works, which has led to a series of copyright infringement behaviors involving performance rights, information network dissemination rights, broadcasting rights, and so on. In view of this, a detailed analysis and research will be conducted on such infringement behaviors and remedies based on relevant judicial cases. In future practice, relevant legal provisions should be improved and refined, public awareness of copyright protection should be cultivated, and the difficulty of copyright owners seeking compensation for losses should be resolved in order to regulate the use of music works in the live streaming industry.
