论法律解释的功能、不足及补足

On the Function, Deficiencies and Complements of Legal Interpretation

摘要: 法律解释是对法律条文规定的说明，对弥补法律的局限性具有重要作用。对于法律解释，需要做广义的理解，不仅包括司法机关制定的具有法律约束力的解释，还包括法官在审理案件时认定事实和适用法律所利用的理由。在肯定法律解释的功能的同时，法律解释因涉及到不同价值的衡量和法官主观性判断的影响，仍具有不足之处。因此，为了改善法律解释理由薄弱和法律解释的固有困境，本文从法律解释的功能出发，论述法律解释的不足并提出补足建议，以促进社会公正和司法结果的正当性。

Abstract: Legal interpretation is the explanation of legal provisions, which plays an important role in making up for the limitations of the law. Legal interpretation needs to be understood in a broad sense, including not only legally binding interpretations formulated by judicial organs, but also the reasons used by judges to determine facts and apply law when adjudicating cases. While affirming the function of legal interpretation, legal interpretation still has shortcomings because it involves the measurement of different values and the influence of judges’ subjective judgments. Therefore, in order to improve the weak reasons for legal interpretation and the inherent dilemma of legal interpretation, this paper discusses the deficiencies of legal interpretation and puts forward supplements to make up for it from the perspective of the function of legal interpretation, so as to promote social justice and the legitimacy of judicial results.
