数字经济时代下的反垄断法律规制研究

Research on Anti-Monopoly Legal Regulations in the Era of Digital Economy

摘要: 数字经济时代下开展反垄断法律规制研究，旨在准确把握数字经济发展规律和数字平台竞争特点，厘清数字垄断行为边界，揭示数字反垄断面临的新情况新问题，凝聚共识，为反垄断执法机构及时有效规制数字垄断提供理论支撑和实践指引。由于数字平台依托数据、算法、网络效应等，加速形成市场支配地位，出现了一系列的垄断行为，急需反垄断法律及时作出回应。本研究系统梳理了数字经济给反垄断执法带来的新问题，重点剖析了数字垄断行为的表现形式。然后在此基础上，提出一系列的对策建议，有助于加快构建起统一、高效、权威的数字经济反垄断法律规制体系，推动数字经济在规范有序的轨道上健康发展。

Abstract: Research on anti-monopoly legal regulations in the era of the digital economy aims to accurately understand the development patterns of the digital economy and the characteristics of competition among digital platforms. It seeks to clarify the boundaries of digital monopolistic behavior, reveal the new situations and challenges faced by digital anti-monopoly, and build consensus to provide theoretical support and practical guidance for anti-monopoly enforcement agencies in effectively and promptly regulating digital monopolies. As digital platforms leverage data, algorithms, and network effects to accelerate the formation of market dominance, a series of monopolistic behaviors have emerged, necessitating a timely response from anti-monopoly laws. This study systematically reviews the new issues that the digital economy presents for anti-monopoly enforcement, with a focus on analyzing the manifestations of digital monopolistic behaviors. Based on this analysis, it proposes a series of recommendations aimed at accelerating the establishment of a unified, efficient, and authoritative legal regulatory framework for anti-monopoly in the digital economy, promoting the healthy and orderly development of the digital economy.
