摘要: 电商平台的出现满足了人们对便利化和效率化生活的追求，但其却可能造成多种新型网络犯罪，新的网络运作模式给我国现有的刑法理论和刑罚体系造成了很大的冲击。《刑法修正案九》首次规定了拒不履行信息网络安全管理义务罪，随后发布了有关的司法解释，但因其没有对电商平台等各种网络服务提供方及其信息网络安全管理义务进行具体规定，导致本罪在有关电商平台司法活动中难以适用。故应通过对网络服务提供方的功能划分和界定其具体信息网络安全管理义务，以此来解决其认定中存在的有关问题。

Abstract: The emergence of e-commerce platforms has met people’s pursuit of convenience and efficiency in life, but it may also lead to a variety of new types of cybercrimes. The new mode of operation of the internet has caused a great impact on China’s existing criminal theory and punishment system. The Ninth Amendment to the Criminal Law stipulates the crime of refusing to fulfill obligations in the management of information networks for the first time, followed by the release of relevant judicial interpretations. However, it has not specified the specific obligations of various network service providers, including e-commerce platforms, and their information network security management obligations, which resulted in the difficulty of applying this crime in the judicial activities of the relevant e-commerce platforms. Therefore, it is necessary to define and specify the specific information network security management obligations of network service providers through functional division, in order to solve the problems of identification in this crime.
