我国金融领域存在的犯罪属于典型的法定犯，金融风险冲击着每个人的神经，作为社会最后保障手段的刑法，理应当对此作出回应。金融刑法是对金融犯罪活动的刑法规制，是法定犯时代研究的又一新领域，有必要明确其内涵与外延。Crime of the financial sector in China belongs to the Mala prohibita. Financial risk impacts on eve-ryone’s nerves. Criminal law, as a social last security should be responded to such situation. Fi-nancial criminal law is on the phenomenon of financial crime. Criminal law is making a new field of research in the Mala prohibita age; it is necessary to clarify financial criminal law connotation and denotation.
