电子商务环境中短视频平台的侵权责任探究

Research on Infringement Liability of Short Video Platform in E-Commerce Environment

摘要: 随着信息时代的发展，技术运用虽然在很大程度上促进了短视频行业的繁荣，但是其造成的负面影响和短视频的著作权的保护问题也引发了人们的思考。在这种侵权中，平台一方受到“避风港原则”和“红旗原则”的偏向保护，使著作权人陷入不利境地。本文以电子商务环境中短视频平台的侵权责任为研究对象，探究在算法推荐技术运用之下，关于算法加持下产生的新问题、立法标准不明确、避风港原则在新形势下的适用问题，并提出相应的对策和建议。

Abstract: With the development of the information age, although the application of technology has promoted the prosperity of the short video industry to a large extent, its negative impact and the protection of the copyright of short video have also triggered people’s thinking. In this kind of infringement, the platform party is protected by the “safe harbor principle” and “red flag principle”, which makes the copyright owner into a disadvantageous situation. This paper takes the infringement liability of short video platform in e-commerce environment as the research object, explores the application of algorithm recommendation technology, new problems arising from algorithm endorsement, unclear legislative standards, and the application of safe harbor principle in the new situation, and puts forward corresponding countermeasures and suggestions.
