知识产权视角下我国非物质文化遗产保护困境与优化策略

Dilemma and Optimization Strategies of Intangible Cultural Heritage Protection in China from the Perspective of Intellectual Property

摘要: 我国的非物质文化遗产是中华文明绵延传承的生动见证，是中华优秀传统文化的重要组成部分，本文在分析我国非物质文化遗产立法保护现状的基础上，明确了非物质文化遗产因其知识产权属性、经济属性和知识产权制度的开放性，指出了我国非物质文化遗产在权利主体界定、立法保护、传承人权利保护机制以及客体独创性方面的问题，并给予有效优化策略，以实现对非物质文化遗产的切实保护。

Abstract: Our intangible cultural heritage is a living testimony to the long succession of Chinese civilization and an important part of our fine traditional culture. On the basis of an analysis of the current situation of our legislative protection of intangible cultural heritage, this paper clarifies the openness of intangible cultural heritage due to its intellectual property, economic attributes, and intellectual property system, points out the problems of our intangible cultural heritage in the definition of subjects of rights, legislative protection, the mechanism for protecting the rights of inheritors and the originality of objects, and gives effective strategies for optimization to achieve effective protection of the intangible cultural heritage.
