电商平台知识产权恶意投诉的规制研究

Study on the Regulation of Malicious Complaints of Intellectual Property Rights on E-Commerce Platforms

摘要: 电子商务对我国数字经济的发展产生了重大的影响，其快速发展的同时也引发了大量知识产权侵权行为。在实践中，部分权利人可能滥用“通知–删除”规则来获取在电子商务平台上的竞争优势，这种行为不仅会损害电商平台内其他经营者的合法权益，也会破坏市场竞争秩序。因此，本文从电子商务领域知识产权的恶意投诉现象为切入点，分析电商平台知识产权恶意投诉的构成要件以及形成恶意投诉现象的原因，并提出相关意见及解决方案，以促进电子商务平台经营者、电子商务平台以及整个市场经济秩序和谐稳定发展。

Abstract: E-commerce has had a significant impact on the development of China’s digital economy, and its rapid development has also triggered a large number of intellectual property infringements. In practice, the right holder abuses the “notice-to-delete” rule in order to obtain the competitive advantage of operating on the e-commerce platform, which not only harms the legitimate rights and interests of other operators on the e-commerce platform, but also destroys the order of market competition. Therefore, this paper takes the phenomenon of malicious complaints of intellectual property rights in the field of e-commerce as an entry point, analyzes the constituent elements of malicious complaints of intellectual property rights on e-commerce platforms as well as the reasons for the formation of the phenomenon of malicious complaints, and then puts forward the corresponding suggestions and measures to promote the harmonious and stable development of e-commerce platform operators, e-commerce platforms as well as the entire market economic order.
