电商平台知识产权侵权注意义务研究

Study on the Duty of Care for Intellectual Property Infringement on E-Commerce Platforms

摘要: 电子商务的发展与知识产权保护息息相关，对电商平台在知识产权侵权中的注意义务进行深入研究，不仅可以促进法律贯彻执行，还能使电商平台真正发挥第三方主体保护知识产权的职能。通过分析电商平台知识产权注意义务存在的现实问题，提出司法者在判定电商平台的注意义务时，应当明确注意义务应当包含审查义务，将不同类型电商平台灵活适用不同层次的注意义务，明确有效通知的要件。推进知识产权保护体系下，电商行业的健康发展。

Abstract: The development of e-commerce is closely related to the protection of intellectual property rights, and an in-depth study on the duty of care of e-commerce platforms in intellectual property infringement can not only promote the implementation of the law, but also enable e-commerce platforms to truly play the function of third-party subjects to protect intellectual property rights. By analyzing the real problems of the e-commerce platform’s duty of care in intellectual property rights, it is proposed that when judging the duty of care of the e-commerce platform, the judiciary should make it clear that the duty of care should include the duty of review, apply different levels of duty of care flexibly to different types of e-commerce platforms, and make clear the elements of effective notification. This will promote the healthy development of the e-commerce industry under the intellectual property protection system.
