Research on Legal Issues Related to Minors’ Online Live Streaming Tipping on E-Commerce Platforms

摘要: 随着网络直播行业的迅猛发展，未成年人通过直播平台进行打赏的现象日益增多，引发了广泛的社会关注和法律争议。由于未成年人打赏行为的法律效力认定困难、责任主体缺失等问题，现有法律制度难以充分应对未成年人网络直播打赏行为带来的实际法律需求。本文从未成年人打赏行为的法律性质入手，深入探讨了现行法律规定的不足，并对打赏行为的法律性质界定进行了分析。在此基础上提出了相应的法律规制建议，包括完善立法保护机制、明确打赏行为的法律效力认定标准、强化平台监管责任以及加强对监护人和未成年人的教育引导。这些措施旨在构建多方协作的法律保障体系，为维护未成年人权益和推动网络直播行业的健康发展提供有力支持。

Abstract: With the rapid development of the online live streaming industry, the phenomenon of minors tipping through live streaming platforms is increasing, which has aroused widespread social concern and legal controversy. Due to problems such as the difficulty in determining the legal validity of minors tipping and the lack of responsible entities, it is difficult for the existing legal system to adequately respond to the actual legal needs brought about by minors’ online livestreaming tipping. Starting from the legal nature of minors tipping, this paper deeply discusses the shortcomings of the current legal provisions and analyzes the definition of the nature of tipping. On this basis, corresponding legal regulation suggestions are put forward, including improving the legislative protection mechanism, clarifying the criteria for determining the legal effect of tipping behavior, strengthening the supervision responsibility of the platform, and strengthening the education and guidance of guardians and minors. These measures aim to build a multi-party legal safeguard system to provide strong support for safeguarding the rights and interests of minors and promoting the healthy development of the online live streaming industry.
