民法典背景下基层社会治理的法律困境及策略

Legal Dilemma in Grass-Roots Social Governance and Strategies for Resolving this Dilemma under the Background of Civil Code

摘要: 《民法典》实施以来，基层社会治理在法律适用中面临多重困境，包括法律与实际应用脱节、多元利益冲突加剧以及基层执法难度提升。法律条文的普适性与基层复杂多样的实际情况难以匹配，导致在物权纠纷、公共利益与个人权利冲突等方面，难以找到统一的解决方式。同时，基层治理中的利益纠纷日趋复杂，公共资源分配和物业管理等问题频频引发居民矛盾，而执法资源的不足和专业知识缺乏，进一步制约法律的实际执行。为应对这些困境，提出增强普法教育覆盖、构建多元化纠纷解决机制、提升基层执法能力、推动社区共治机制的策略，以期在基层建立更加有效的法治体系。这些策略不仅有助于加强基层居民的法律意识，也能提高治理的精准性和效率，为构建和谐社区提供法治支持。

Abstract: Since the implementation of the “Civil Code”, grass-roots social governance has faced multiple dilemmas in the application of law, including the disconnection between law and practical application, the intensification of multiple interest conflicts and the difficulty of grass-roots law enforcement. It is difficult to match the universality of legal provisions with the complex and diverse actual situation at the grass-roots level, which leads to the difficulty in finding a unified solution in real right disputes, conflicts between public interests and individual rights. At the same time, the interest disputes in grass-roots governance are becoming more and more complicated, and problems such as the allocation of public resources and property management frequently cause conflicts among residents, while the lack of law enforcement resources and professional knowledge further restricts the actual implementation of the law. In order to deal with these dilemmas, this paper puts forward some strategies, such as strengthening the coverage of legal education, constructing diversified dispute resolution mechanisms, improving the ability of grass-roots law enforcement and promoting the mechanism of community co-governance, in order to establish a more effective rule of law system at the grass-roots level. These strategies not only help to strengthen the legal awareness of grass-roots residents, but also improve the accuracy and efficiency of governance and provide legal support for building a harmonious community.
