电子商务产品侵权分析
Analysis of Infringement of E-Commerce Products
摘要: 传统商务中发生的产品侵权只需要考虑消费者与生产者、销售者之间的关系。但是与传统商务模式相比,在电子商务模式当中增加了一个主体,即电子平台经营者,所以在探讨电子商务产品侵权时也要将其纳入考虑范围之内,去研究电子平台经营者的民事责任承担问题。但是在研究该问题时需关注到电子平台它的种类划分,对于不同种类的电子平台,它所提供的服务合同的内容并不一致,因而在分析其上所发生的产品侵权时,依据不同电子平台所扮演的角色的不同,最终其所需承担的责任也有所不同。退一步来说,就算是在同一种电子平台之上,也会因其平台内业务性质的不同而造成不同的责任承担的后果。
Abstract: Product infringement in traditional business only needs to consider the relationship between consumers, producers and sellers. However, compared with the traditional business model, there is an added subject in the e-commerce model, that is, the operator of the electronic platform. Therefore, it should also be taken into consideration when discussing the infringement of e-commerce products to study the civil liability of the operator of the electronic platform. However, in the study of this issue, attention should be paid to the classification of electronic platforms. For different types of electronic platforms, the content of the service contract provided by them is not consistent. Therefore, when analyzing the product infringement occurred on them, the responsibilities they need to bear are also different according to the different roles played by different electronic platforms. To take a step back, even on the same electronic platform, there will be different consequences due to the different nature of the business within its platform.
