摘要: 随着电子商务业务的飞速扩张，现行法律体系在界定电子商务平台经营者法律地位方面存在不足，相关法律关系的界定亦显模糊，这严重阻碍了我国电子商务行业的稳健前行与良性发展。因此本文从保护消费者权益的角度出发，对电子商务平台经营者的概念、特征、法律规制现状和问题进行分析，以及提出完善电子商务平台经营者侵权责任法律适用的路径，为保护消费者权益、规范电子商务市场提供理论支持和实践指导。

Abstract: With the rapid expansion of e-commerce business, the current legal system has shortcomings in defining the legal status of e-commerce platform operators, and the definition of relevant legal relations is also vague, which seriously hinders the steady and benign development of China’s e-commerce industry. Therefore, from the perspective of protecting the rights and interests of consumers, this paper analyzes the concept, characteristics, status quo and problems of legal regulation of e-commerce platform operators, and proposes the path to improve the application of the law of infringement liability of e-commerce platform operators, so as to provide theoretical support and practical guidance for protecting the rights and interests of consumers and standardizing the e-commerce market.
