摘要: 随着算法技术的发展，电商平台广泛运用个性化推荐进行精准营销，一方面个性化推荐有效解决了用户在数据时代面临的信息过载问题，但另一方面其也带来了诸如“算法歧视”、“个人信息泄露”以及版权侵权等法律问题。为规范平台算法推荐拒绝权的适用，减少用户不必要的责任，应首先树立正确的价值观，以数字化治理为动力，以软硬结合为方向，通过协调多方力量，全面提升侵权治理效能。

Abstract: With the development of algorithmic technology, e-commerce platforms have widely used personalized recommendation for precision marketing. Personalized recommendation on the one hand effectively solves the information overload problem faced by users in the data era, but on the other hand, it also brings legal problems such as “algorithmic discrimination”, “leakage of personal information”, and infringement.
