Research on the Civil Legal Liability of E-Commerce Platform Operators

摘要: 信息技术的飞速发展，特别是互联网技术的广泛应用，彻底改变了传统的交易模式，催生了电子商务这一新兴经济形态。随着电子商务的繁荣，平台经营者的法律责任问题愈发凸显。本文深入探讨了电子商务平台经营者在具体交易中的民事法律责任，旨在明确平台经营者的法律责任，为电子商务的健康发展提供法律保障。本文以平台与平台经营者的区分、平台经营者民事法律地位的界定为立足点明晰了电子商务平台经营者的角色与定位。在此基础上，本文重点研究了平台经营者的消费者权益保护责任，以及维护公平交易环境方面的民事法律责任。最后，本文对平台经营者可能面临的直接侵权责任和间接侵权责任加以探讨，并分析了相应的法律后果。

Abstract: The rapid development of information technology, especially the wide application of Internet technology, has completely changed the traditional transaction mode and given birth to the emerging economic form of e-commerce. With the boom of e-commerce, the legal liability of platform operators has become more and more prominent. This article deeply discusses the civil legal liabilities of e-commerce platform operators in specific transactions, aiming to clarify the legal liabilities of platform operators and provide legal protection for the healthy development of e-commerce. Based on the distinction between platforms and platform operators and the definition of the civil legal status of platform operators, this paper clarifies the role and positioning of e-commerce platform operators. On this basis, this paper focuses on the responsibility of platform operators to protect consumer rights and interests, as well as the civil legal liability for maintaining a fair trading environment. Finally, this paper discusses the direct and indirect tort liabilities that platform operators may face, and analyzes the corresponding legal consequences.
