浅谈海事法律文献的语言特点及翻译策略

A Brief Discussion on Language Characteristics and Translation Strategies of Maritime Legal Documents

摘要: 当今航运事业蓬勃发展，造船技术突飞猛进，促使各国间的交流与合作不断加强，相关法律文献日益规范，海事法律法规在规范航运秩序方面提供了有力的法制保证，海事法律文献的英语翻译的质量高低对海运事业的发展、造船技术安全等等有着直接的影响。尤金·奈达的“功能对等”翻译理论在上世纪八十年代介绍到中国，在中国的翻译界产生了显著的影响。本文以“功能对等”翻译理论为指导，从词汇、句法两个层面对贾望星翻译的《中华人民共和国海船船员值班规则》和原文进行分析，探讨海事法律文献的语言特点及翻译策略。

Abstract: With the rapid development of the shipping industry and the rapid development of shipbuilding technology, exchanges and cooperation between countries have been strengthened, and relevant legal documents have become increasingly standardized. Maritime laws and regulations provide a powerful legal guarantee in standardizing shipping orders. The quality of English translation of maritime legal documents has a direct impact on the development of the shipping industry and the safety of shipbuilding technology. Eugene Nida’s “functional equivalence” translation theory was introduced to China in the 1980s and has had a significant impact on Chinese translation circles. Guided by the “functional equivalence” theory, this paper analyzes the Regulations of the People’s Republic of China on Seafarers Watchkeeping and the original text translated by Jia Wangxing from two aspects of vocabulary and syntax, and explores the linguistic features and translation strategies of maritime legal documents.
