摘要: 高校是科技成果的重要产地，研究高校专利开放许可的实施现状与问题，探寻制度方面的不足，有助于我国对开放许可制度的进一步完善。通过对高校近年来的专利开放许可实施情况的相关数据进行深入挖掘和梳理，从许可期限与许可费用两方面出发，深入分析高校专利开放许可实施中存在的问题，并从构建便捷高效的声明变更机制、设置合理的缓冲期、建立科学合理的许可费机制等方面提出对策建议，以期为高校专利开放许可的顺利实施提供理论支持和实践指导。

Abstract: Colleges and universities are the important producing areas of scientific and technological achievements. Studying the implementation status and problems of patent open licensing in colleges and universities and exploring the deficiencies of the system are helpful to further improve the open licensing system in China. Through the colleges and universities in recent years the open patent licensing implementation of related data further mining and combing, starting from the license period and license fee, in-depth analysis of the problems existing in the implementation of the open patent license in colleges and universities, and from building a convenient and efficient statement change mechanism, set up reasonable buffer period, establish a scientific and reasonable licensing fee mechanism put forward countermeasures and suggestions, in order to the smooth implementation of open patent licensing to provide theoretical support and practical guidance.
