部门规章设定行政处罚的合法性分析
Analysis of the Legality of Administrative Punishments Set by Departmental Rules
摘要: 部门规章设定行政处罚一定程度上突破其执行性立法的地位,学界对法律内部的张力以及对“尚未制定法律、行政法规”存在不同理解。文章基于规章设定行政处罚对行政管理现状的作用,并通过对法律释义和学术界不同观点的分析,主要从授权立法的角度对部门规章设定行政处罚进行横向和纵向上的比较,采纳“事项说”的观点,分析部门规章设定行政处罚的合法性,以期达到适当释放和有效限制部门规章立法空间的统一。
Abstract: To a certain extent, the administrative penalties set by departmental rules break through the status of executive legislation, and there are different understandings in the academic circles about the tension within the law and the “laws and administrative regulations that have not yet been formulated”. Based on the role of administrative penalties set by rules on the status quo of administrative management, this paper compares the administrative penalties set by departmental rules horizontally and vertically from the perspective of authorized legislation and analyzes the legitimacy of administrative penalties set by departmental rules from the perspective of “matter theory”, so as to achieve the unity of appropriate release and effective restriction of the legislative space of departmental rules.
