跨境电子商务争议解决现状与困境的相关法律问题研究

Legal Research on Current Status and Challenges in Cross-Border E-Commerce Dispute Resolution

摘要: 跨境电子商务依托平台经济蓬勃发展，该类交易在我国现行法规及监管之下由四类主体构成，其争议也具有涉外且法律关系复杂的特点，然而我国立法和司法实践对跨境电商的争议解决在机构设置、法律适用等方面并未形成普遍适用的规则。这对跨境电子商务发展形成了制约。高标准国际经贸协定发展中强调电子商务的在线纠纷解决的发展与完善，我国电商平台的发展需要结合国际经贸高标准纠纷解决制度，与司法系统、行业协会深度开展技术对接，完善以消费者权益保护为核心的跨境电子商务争端解决制度。

Abstract: Cross-border e-commerce, thriving on the platform economy, is composed of four types of entities under China’s current regulations and supervision. The disputes arising from such transactions are characterized by their foreign-related nature and complex legal relationships. However, China’s legislative and judicial practices have yet to establish universally applicable rules for resolving cross-border e-commerce disputes, particularly in terms of institutional setup and legal application. This has posed constraints on the development of cross-border e-commerce. As high-standard international trade agreements increasingly emphasize the development and improvement of online dispute resolution (ODR) for e-commerce, China’s e-commerce platforms need to align with these international standards in dispute resolution design. This requires deep technical integration with the judicial system and industry associations, aiming to enhance consumer protection as a core element of cross-border e-commerce dispute resolution mechanisms.
