平台经济下算法决策的价格歧视研究

Research on Price Discrimination through Algorithmic Decision-Making in the Platform Economy

摘要: 平台经济作为数字经济的重要组成部分，推动经济的发展，但其中蕴含的因算法决策导致的价格歧视问题也随着经济发展显现。文章分析了算法价格歧视的产生原因，包括数据源偏向性和算法设计偏见，指出其对消费者合法权益和市场竞争秩序的侵害。进而总结我国价格歧视监管体系的现状，并提出了完善反垄断法规、加强监管和治理等建议，以确保算法技术的合法、公正和透明运行，维护市场竞争秩序和消费者权益。

Abstract: Platform economy, as a crucial component of the digital economy, drives economic development. However, issues of price discrimination resulting from algorithmic decision-making inherent in it have also emerged along with economic growth. This paper analyzes the causes of algorithmic price discrimination, including data source bias and algorithmic design prejudice, pointing out its infringement on consumers’ legitimate rights and interests as well as market competition order. Furthermore, it summarizes the current status of China’s price discrimination regulatory system and proposes suggestions such as improving antitrust laws and regulations, strengthening supervision and governance, to ensure the legal, fair, and transparent operation of algorithmic technologies, and to uphold market competition order and consumer rights and interests.
