电子商务视角下我国外国法内容查明制度的立法缺陷与完善路径研究

Study on Legislative Deficiencies and Improvement Paths of China’s Foreign Law Ascertainment System from the Perspective of E-Commerce

摘要: 查明外国法律的内容是一国法院在审理涉外民商事案件中适用冲突规范正确解决法律冲突的重要环节。随着我国“一带一路”倡议的深入推进以及跨境电子商务的蓬勃发展，我国与世界各国的贸易交往越来越密切。文章通过梳理我国外国法查明制度的立法历程，结合国际贸易与电子商务领域的实际需求，分析现行立法在跨境交易场景中的不足，并提出针对性建议，以期推动该制度更好地适应数字经济和全球化贸易的新挑战。

Abstract: Ascertaining the content of foreign laws is an important link for a court of a country to apply conflict rules correctly and resolve legal conflicts when hearing foreign-related civil and commercial cases. With the in-depth promotion of China’s Belt and Road Initiative and the vigorous development of cross-border e-commerce, China’s trade exchanges with countries around the world have become increasingly close. By sorting out the legislative process of the foreign law verification system in China and combining the actual needs in the fields of international trade and e-commerce, this article analyzes the deficiencies of the current legislation in the context of cross-border transactions and puts forward targeted suggestions, with a view to promoting the system to better adapt to the new challenges of the digital economy and globalized trade.
