论电子商务平台经营者的积极协助义务——对《电子商务法》第61条的评注

On the Active Assistance Obligations of E-Commerce Platform Operators—Commentary on Article 61 of the E-Commerce Law

摘要: 《中华人民共和国电子商务法》(以下简称《电子商务法》)第61条规定了电子商务平台经营者在消费者与平台内经营者发生争议时的积极协助义务。该条款的出台旨在通过强化平台责任，优化消费者权益保护机制，但其在司法实践中的适用仍存在义务边界模糊、履行标准不明确、责任承担机制不完善等问题。本文从法律文本出发，结合司法案例和学界观点，分析第61条的立法意图与制度缺陷，并提出通过细化义务内容、完善配套规则、强化技术监管等路径，推动积极协助义务的实质化落实。

Abstract: Article 61 of the Electronic Commerce Law of the People’s Republic of China (hereinafter referred to as the “E-Commerce Law”) stipulates the active assistance obligation of e-commerce platform operators in the event of disputes between consumers and platform operators. The introduction of this clause aims to strengthen platform responsibilities and optimize consumer rights protection mechanisms, but its application in judicial practice still faces problems such as unclear obligation boundaries, unclear performance standards, and imperfect responsibility mechanisms. This article starts from legal texts, combines judicial cases and academic perspectives, analyzes the legislative intent and institutional deficiencies of Article 61, and proposes ways to promote the substantive implementation of active assistance obligations through refining the content of obligations, improving supporting rules, and strengthening technical supervision.
