《电子商务法》中授权立法条款设置问题研究

Research on the Establishment of Authorized Legislative Provisions in “E-Commerce Law”

摘要: 当下，电子商务飞速发展，不断带动经济快速增长，在这背后也带来了新的问题，如线上交易安全保证、行业发展对不同主体间的利益调整等，这些问题均要求法律规范作出明确规定。现有《电子商务法》虽已对这些方面作出法律规制，但其中部分属于授权立法条款，需要授权给其他立法主体进一步立法对该行业进行相关规定。通过对《电子商务法》中授权立法条款内容及实施效果进行分析，针对当前授权立法条款存在的问题，如默示授权条款数量过多、授权表达缺乏明确性、立法语言不规范等问题提出改善建议，以期为我国电子商务行业的完善提供指引与法治保障。

Abstract: At present, e-commerce is developing rapidly and continuously driving the rapid growth of the economy. Behind this, however, new legal risks have emerged, such as how to ensure the security of online transactions and how the industry will develop in the future. All these issues require clear regulations from legal norms. Although the current “E-Commerce Law” has made legal regulations in these aspects, some of them are authorization legislation provisions, which need to be authorized to other legislative bodies to further legislate and make relevant regulations for this industry. By analyzing the content and implementation effect of the authorization legislation provisions in the “E-commerce Law”, this paper puts forward improvement suggestions for the existing problems in the current authorization legislation provisions, such as too many implied authorization provisions, lack of clarity in authorization expressions, and non-standard legislative language, in order to provide guidance and legal protection for the improvement of China’s e-commerce industry.
