电商平台监管的双重困境与治理路径

摘要: 在数字经济蓬勃发展的时代背景下，电商平台迅速崛起，电商平台的公私双重属性导致其自我规制存在较大局限，需要行政监管机制的介入，以保障网络交易主体合法权益，促进电子商务产业健康发展。然而，电商平台作为消费、生产与流通的核心枢纽，其监管难题日益增加。本文聚焦电子商务平台行政监管困境与治理转型，分析监管对象的双重属性及监管目标多元价值的冲突性，针对责任边界模糊、监管能力滞后与利益平衡失序等现实困境，提出完善法律体系、创新监管机制与构建协同治理的优化路径。

Abstract: In the context of the vigorous development of the digital economy, the rapid rise of e-commerce platforms, the dual attributes of public and private e-commerce platforms lead to great limitations in their self-regulation, and the intervention of administrative supervision mechanisms is needed to protect the legitimate rights and interests of online transaction entities and promote the healthy development of the e-commerce industry. However, as the core hub of consumption, production and circulation, e-commerce platforms are facing increasing regulatory challenges. This paper focuses on the dilemma of administrative supervision and governance transformation of e-commerce platforms, analyzes the dual attributes of regulatory objects and the conflict of multiple values of regulatory objectives, and proposes an optimization path to improve the legal system, innovate the regulatory mechanism and build collaborative governance in view of the practical dilemmas such as blurred responsibility boundaries, lagging regulatory capabilities and disorderly balance of interests.
