On the Civil Liability of E-commerce Platform Operators

摘要: 随着电子商务的快速发展，平台经营者在经济活动中的角色日益重要，其民事责任问题也成为法律研究的焦点。本文以“电子商务平台经营者的民事责任规范”为研究对象，结合《中华人民共和国民法典》《电子商务法》等相关法律法规，探讨平台经营者在直接侵权和间接侵权中的责任认定标准及适用规则。研究指出，平台经营者的民事责任主要包括直接侵权责任和间接侵权责任：前者源于平台自身实施的侵权行为，后者则因平台未履行合理注意义务而对第三方侵权行为承担责任。本文针对现行法律规范的不足，提出完善平台经营者民事责任体系的建议，以平衡权利人保护、用户权益维护与平台健康发展之间的关系，为电子商务领域的法治建设提供理论支持。

Abstract: With the rapid development of e-commerce, platform operators play an increasingly important role in economic activities, and their civil liability has become the focus of legal research. This paper takes the “norms of civil liability of E-commerce platform operators” as the research object, and combines the relevant laws and regulations such as the Civil Code of the People’s Republic of China and the E-commerce Law to discuss the standards and applicable rules of liability identification of platform operators in direct infringement and indirect infringement. The research points out that the civil liability of platform operators mainly includes direct tort liability and indirect tort liability: the former is caused by the platform’s own infringement, while the latter is responsible for the third party’s infringement due to the platform’s failure to perform the duty of reasonable care. This paper further analyzes the identification criteria of “knowing or should have known”, the specific application of the “notice-delete” rule, and the compliance requirements of the platform in technical means and management measures. Finally, in view of the deficiencies of the current legal norms, suggestions are put forward to improve the civil liability system of platform operators, so as to balance the relationship between the protection of rights holders, the maintenance of users’ rights and interests and the healthy development of platforms, and provide theoretical support for the construction of the rule of law in the field of e-commerce.
