算法控制背景下平台用工关系认定问题研究
Research on the Identification of Platform Employment Relationship under the Background of Algorithmic Control
摘要: 数字经济时代,互联网平台经济蓬勃发展,平台用工关系日益复杂,特别是算法控制下的用工关系对现行劳动关系认定体系提出了严峻挑战。本文分析了算法控制背景下平台用工关系的特征,包括主体角色转变、用工结构复杂化及用工方式灵活性增强。进而探讨了平台用工关系认定面临的困境,如用工主体认定模糊、从属性标准失灵及获取认定证据困难。为应对这些挑战,本文提出了坚持事实优先原则、优化劳动从属性标准和完善举证责任分配制度等完善路径,以期构建更加公平、合理的平台用工关系认定体系,保障劳动者权益,促进平台经济规范发展。
Abstract: In the era of the digital economy, the internet platform economy is booming, and platform employment relationships have become increasingly complex. In particular, employment relationships under algorithmic control pose severe challenges to the current system for identifying labor relationships. This paper analyzes the characteristics of platform employment relationships in the context of algorithmic control, including the transformation of subject roles, the complication of employment structures, and the enhanced flexibility of employment methods. Furthermore, it discusses the difficulties faced in identifying platform employment relationships, such as ambiguity in identifying the employing entity, the failure of subordination standards, and difficulties in obtaining evidence for identification. To address these challenges, this paper proposes several improvement paths, including adhering to the principle of prioritizing facts, optimizing labor subordination standards, and improving the distribution of the burden of proof. The aim is to establish a fairer and more reasonable system for identifying platform employment relationships, safeguard laborer rights and interests, and promote the standardized development of the platform economy.
