Pragmatic Balancing Mechanisms in Judicial Discourse: A Cross-Cultural Comparison of Face Negotiation and Pragmatic Enrichment

摘要: 本文从语用学视角切入，探讨法律话语中面子协商与语用充实的互动机制及其跨文化差异，通过对比中西方的司法实践，揭示不同法系下语言策略的制度根源与文化嵌入性。研究提出“面子协商–语用充实”联动模式，即在庭审、判决和调解过程中的面子协商与法律渊源适用时的语用充实运用有机结合，揭示话语的语用作用在法律实施和实现各过程的粘合作用，并指出国际商事仲裁中语用策略的文化敏感性。

Abstract: This study adopts a pragmatic perspective to explore the interactive mechanisms between face negotiation and pragmatic enrichment in legal discourse, as well as their cross-cultural variations. By comparing judicial practices in Chinese and Western legal systems, the research reveals the institutional roots and cultural embeddedness of linguistic strategies under different legal traditions. A “face negotiation—pragmatic enrichment” linkage model is proposed, demonstrating how the interplay of face negotiation (in court proceedings, judgments, and mediation) and pragmatic enrichment (in the application of legal sources) cohesively bridges discourse pragmatics with legal implementation. The study further highlights the cultural sensitivity of pragmatic strategies in international commercial arbitration.
