人工智能推荐的法律规制研究——基于用户心理保护视角

Research on the Legal Regulation of Artificial Intelligence Recommendations—Based on the Perspective of User Psychological Protection

摘要: 人工智能推荐由于其高效、便捷和低成本等特点，已在多领域广泛使用。但在带来效益的同时，该技术的应用也会给用户心理造成伤害，损害了用户健康权。目前，相关法律规制面临法律界定模糊、监管部门责任复杂、法律救济滞后、技术发展迅速导致规制不足等困境，用户权益难以得到保障。为完善法律规制，需要明确法律界定责任主体，加强执法监管体制、完善法律救济机制并合理引导技术发展。通过这些措施可以更好地保护用户心理健康，促进人工智能技术的健康发展。

Abstract: Artificial intelligence recommendation has been widely used in multiple fields due to its efficiency, convenience and low cost. While bringing benefits, the application of this technology can also cause harm to users’ psychology and impair their right to health. At present, the relevant legal regulation faces the dilemmas of vague legal definition, complicated responsibility of regulatory authorities, lagging legal remedies, and insufficient regulation due to the rapid development of the technology, which makes it difficult to protect the rights and interests of users. In order to improve legal regulation, the main body of responsibility should be clearly defined in the law, the law enforcement and regulatory system should be strengthened, the legal relief mechanism should be improved, and the development of technology should be reasonably guided. Through these measures, the psychological health of users can be better protected and the healthy development of AI technology can be promoted.
