国际商事仲裁裁决书中的中英转换问题研究

摘要: 本研究基于对中国国际经济贸易仲裁委员会(CIETAC)及国际商会仲裁院(ICC)等机构裁决书的分析，系统探讨了中英术语转换中的典型误译现象及其成因。研究发现，法律体系差异、语言转换障碍及质量管控机制缺失是导致术语偏差和句式问题的主要原因。针对这些问题，本文从术语规范、质量控制及仲裁员语言能力建设三个维度提出改进建议，包括构建分级术语库、完善裁决书审查流程以及加强专业培训等。这些建议不仅有助于提升中国仲裁文书的国际认可度，也为法律语言学在仲裁领域的应用提供了新的思路。

Abstract: This study systematically examines typical mistranslation phenomena and their causes in Chinese-English terminology conversion through an analysis of arbitral awards issued by the China International Economic and Trade Arbitration Commission (CIETAC) and the International Court of Arbitration (ICC). The findings reveal that disparities in legal systems, language conversion barriers, and the lack of quality control mechanisms are the primary reasons for terminology deviations and syntactical issues. To address these problems, this paper proposes improvement measures from three dimensions: terminology standardization, quality control, and arbitrator language proficiency enhancement, including the establishment of a tiered terminology database, refinement of award review procedures, and specialized training programs. These recommendations not only contribute to improving the international recognition of Chinese arbitral documents but also provide new insights for the application of legal linguistics in the field of arbitration.
