摘要: 跨境电商代发模式具有低门槛、高灵活等特性，推动了中小经营主体的数字化转型，但在其快速发展的同时，暴露出多重合规风险，具体包括刑事违法风险、民事侵权风险及行政违法风险。风险成因主要包括经营者法律意识淡薄、平台责任界定不清、治理机制滞后及监管体系碎片化。为解决上述问题，应构建全链条合规治理框架，具体涵盖提升市场主体的法治素养、建立统一高效的跨部门监管体系、明确平台的合规责任边界、推动智能化监管平台建设及监管机制市场化等路径，旨在促进跨境电商代发模式的健康有序发展。

Abstract: The cross-border e-commerce drop-shipping model, characterized by low entry barriers and high flexibility, has facilitated the digital transformation of small and medium-sized business entities. However, its rapid development has also exposed multiple compliance risks, including criminal violation risks, civil infringement risks, and administrative violation risks. The causes of these risks mainly include the weak legal awareness of operators, unclear definition of platform responsibilities, lagging governance mechanisms, and fragmented regulatory systems. To address these issues, a comprehensive compliance governance framework should be established, covering enhancing the legal literacy of market entities, establishing a unified and efficient cross-departmental regulatory system, clarifying the compliance responsibility boundaries of platforms, promoting the construction of intelligent regulatory platforms, and marketing regulatory mechanisms. The aim is to promote the healthy and orderly development of the cross-border e-commerce drop-shipping model.
